Settlement in Automobile Crash Case Involving Intoxicated Minor

In a recent automobile accident case a winery in Santa Rosa has settled the case and agreed to pay $3 million in settlement to a Sebastopol man who received permanently disabling brain injuries in an alcohol related car crash. The lawsuit stated that the Paradise Ridge Winery served alcohol to a minor at a wedding reception who then crashed his car with Joshua Apodoca in the passenger seat. The minor agreed to pay $100,000 and Seven-Eleven where the minor purchased additional alcohol paid $500,000.

The minor suffered a serious brain injury and the settlement was to be used to pay the cost of life-time home care and for the purchase of a home outfitted for the disabled.

The winery served the minor 6-8 beers dispute him saying that he had left his identification in his car.

The minor had a blood-alcohol level of .14, nearly twice the legal limit. He was convicted of driving under the influence and was sentenced to nine months in jail.

California law says a bar or winery is not responsible for what a patron does once he is out the door, but the case fell under an exception that prohibits serving alcohol to an obviously intoxicated minor.
